Terms of Service

1. Acceptance of Terms
By accessing or using SKYCOT ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.
2. Description of Service
SKYCOT is an AI-powered application building platform. You describe what you want to build, and SKYCOT compiles your intent into a fully functioning application using archetype-based generation, test-driven development, and automated deployment. The Service includes project creation, AI-assisted code generation, live preview, and one-click deployment.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to update it as necessary. You must be at least 16 years old to create an account.
4. Subscriptions & Payments
SKYCOT is a paid service with tiered subscription plans. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase.
- Subscriptions are billed monthly and renew automatically unless cancelled.
- Each plan includes a monthly token allowance. Exceeding your allowance incurs overage charges at the rate specified for your tier.
- You may upgrade, downgrade, or cancel your subscription at any time from your account settings. Changes take effect at the start of the next billing cycle.
- Refunds are available within 7 days of initial subscription or tier upgrade if no builds have been run during that period.
- All payments are processed securely through Stripe. SKYCOT does not store your full credit card details.
5. Acceptable Use
You agree not to use the Service to:
- Generate applications that are illegal, harmful, or violate the rights of others.
- Attempt to reverse-engineer, decompile, or extract the underlying AI models or proprietary systems.
- Circumvent usage limits, token tracking, or subscription restrictions.
- Distribute malware, phishing pages, or applications designed to deceive users.
- Overload or disrupt the Service through automated or excessive requests.
- Share your account credentials or allow unauthorised access.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
6. Intellectual Property & Ownership
Your content: You retain full ownership of the application descriptions, project configurations, and business logic you provide. The code generated by SKYCOT for your projects is yours to use, modify, and distribute without restriction.
Our platform: The SKYCOT platform, including its compilation engine, archetype system, UI components, and underlying technology, remains the intellectual property of SKYCOT. You may not copy, modify, or redistribute the platform itself.
Open-source components: Generated applications may include open-source dependencies governed by their respective licences. You are responsible for complying with those licences.
7. Generated Code
Code generated by SKYCOT is provided on an "as-is" basis. While we strive for production-quality output through test-driven generation and automated verification, you are responsible for reviewing, testing, and validating generated code before deploying it to production. SKYCOT does not guarantee that generated code is free of bugs, security vulnerabilities, or errors.
8. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.
9. Limitation of Liability
To the maximum extent permitted by law, SKYCOT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.
11. Termination
You may close your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after account closure to allow recovery, after which it will be permanently deleted.
12. API Usage & Fair Use
Your use of the SKYCOT platform is subject to the following usage policies:
- Token allowance: Each subscription tier includes a monthly token allowance. Token consumption is tracked per build and displayed transparently before and after each build.
- Rate limiting: To ensure fair access for all users, we enforce rate limits on build requests and API calls. Starter plans are limited to 5 concurrent builds; Pro to 10; Business to 20. Exceeding these limits will queue additional requests.
- Fair use: All plans are subject to a fair use policy. Automated or scripted abuse of the build system, excessive polling, or systematic attempts to extract AI model outputs outside of normal application building constitute violations and may result in account suspension.
- Overage charges: If you exceed your monthly token allowance, additional usage will be charged at the per-million overage rate specified for your tier. You will be notified when you reach 80% and 100% of your allowance.
13. Auto-Renewal & Cancellation
In accordance with Australian Consumer Law and applicable international regulations:
- Auto-renewal: Your subscription will automatically renew at the end of each billing period (monthly or annually) at the then-current rate unless you cancel before the renewal date.
- Renewal notification: We will send you an email reminder at least 7 days before each renewal date, including the renewal amount and instructions for cancellation.
- How to cancel: You may cancel your subscription at any time from your Account Settings page. Cancellation takes effect at the end of your current billing period — you will retain access until then.
- Price changes: If we increase subscription prices, we will notify you at least 30 days in advance. The new price will apply from your next renewal date, giving you the option to cancel before it takes effect.
- No penalty for cancellation: There are no cancellation fees or penalties. You will not be charged after your current billing period ends.
14. Force Majeure
Neither party shall be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond the reasonable control of the affected party, including but not limited to: natural disasters, acts of government, pandemics, war or civil unrest, power or internet outages, third-party service provider failures (including AI model API providers, cloud infrastructure, or payment processors), cyberattacks, or labour disputes. The affected party will use reasonable efforts to mitigate the impact and resume performance as soon as practicable.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
